Terms of Use

Any use by you of the Site is conditional upon your acceptance of these terms and conditions of use (“Terms”).
We reserve the right to amend these Terms from time to time without notice and at our discretion. It is your responsibility periodically to review this page for updates to these Terms, which shall come into effect once posted. Your continued use of the Site will be deemed confirmation that you have read, understood and accepted these Terms.
All references to “our”, “us”, “we” or “ERP” within these Terms are deemed to refer to ERP Spain.

1. Privacy and personal data

Your rights to confidentiality and privacy together with the security of your data are some of ERP top priorities. You will find below the great principles that lead ERP action in view of protecting your personal information.

We may collect and process the following data about you, that is to say this data that identifies you or can be used to identify you and may include your name, address, email address, user IP addresses in circumstances where they have not been deleted or anonymized, and telephone number. Such information may be collected when you register as a member, posting material, contacting or requesting further services from us.

Your personal data collected by ERP Spain is subject to IT processing to perform customers management operations including sale, marketing, maintenance, verification and statistical analysis and support to services proposed by ERP. There is no obligation to provide your data to ERP. Your personal data collected through this website may be provided by ERP to other entities of the ERP group within the European Union and outside the European Union. The entities of ERP group implement some internal policies to secure the highest level of protection of your data.
From time to time, ERP accountants or subcontractors who have a need to know may also be entrusted with the information. to carry out our obligations arising from any contracts entered into between you and us; to allow you to participate in features of our service, when you choose to do so; to notify you about changes to our service; otherwise as permitted under applicable law.

There is no obligation to provide your data to ERP. Your personal data collected through this website may be provided by ERP to other entities of the ERP group within the European Union and outside the European Union. The entities of ERP group implement some internal policies to secure the highest level of protection of your data.

From time to time, ERP accountants or subcontractors who have a need to know may also be entrusted with the information. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our Site constitutes a violation of their intellectual property rights, or of their right to privacy.

Should there be any information changes with a company under a different procedure than the one described above, we will contact you beforehand and give you the opportunity to remove your information from our database, unless you have already given us your consent to such information changes.

We will keep your information for a reasonable period of time according to its purpose. This information will be deleted following the conservation deadline applied to our databases. If you wish to be informed about the time limit for retention of data according to the database in which your data is found, please do not hesitate to contact us.

ERP Spain has no intention of collecting personal identification data of children under 18. If the parent or legal guardian discovers that an under-age person has entered personal information in our database, please contact us, so that this information can be immediately deleted from our records.

2. ERP Site cookie policy

How we use cookies? A cookie is a small file which asks permission to be placed on your computer’s hard drive. 3. Intellectual property rights and confidentiality

The online user is not allowed to reproduce, copy, disseminate or use them in any other way without the prior written consent of ERP. You may view this Site and print hard copies of material on it solely for your lawful, non-commercial use.

If you choose, or you are provided with, a user identification code, password or other information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party.

With the exception of the Members login section and personal data which are covered under section 1, any material or data you upload to our Site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose.
Any data our Members enter within the Members login section in application of a signed membership agreement is subject to the confidentiality terms contained in the Membership Agreement.
Any data our business partners enter within any login section in application of a signed agreement is subject to the confidentiality terms contained in such Agreement.

4. Acceptable use policy

You will not use this Site or any of its facilities and/or services for any illegal or unlawful purpose or for any purpose that is prohibited by these Terms. You will not use this Site in any manner which could damage, disable, overburden or impair this Site, the facilities and/or services that are available on it or interfere with any other party’s use of this Site, its facilities and/or services. No website may be linked to this Site or its pages without our prior written consent.

Whenever you make use of a feature that allows you to upload material to our Site, or to make contact with other users of our Site, you warrant that any such contribution does comply with the acceptable use policy.

5. Liabilities

This Site is available without any representations or warranties of any kind, either express or implied to the fullest extent permitted by applicable law. All use by you of the Site is at your own risk. You assume complete responsibility for, and for all risk or loss resulting from your use of the Site. You agree that we will not be liable for damages arising out of your use or your inability to use the Site, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material, and you hereby waive any and all claims with respect thereto, whether based on contract, tort or other grounds.
We reserve the right to withdraw or amend the service we provide on our Site without notice. We will not be liable if for any reason our Site is unavailable at any time or for any period.

Subject to the foregoing provisions of this clause, ERP its officers, affiliates and other representatives total aggregate liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise in connection with or arising from these terms shall not exceed €50 (fifty euro).

Commentary and other materials posted on our Site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our Site, or by anyone who may be informed of any of its contents.
