Focus on… Belarus

As reported in February this year (see article here), the current EPR legislation in Belarus is going to be replaced by completely new legislation in July this year. The concept of EPR was introduced in Belarus by Presidential Decree No. 313 On Some Issues about Treatment of Household Waste, in 2012.

Earlier this year, Presidential Decree No. 16 On Improving Management of Waste Products and Packaging already substituted some of the provisions of the initial Decree and set the deadline for the Council of Ministers to present the implementing legislation by 1st July 2020.

Consequently, the following were published for discussion on the official legal forum in April and May respectively:

  • draft Decision of the Council of Ministers of the Republic of Belarus On the Implementation of the Decree of the President of the Republic of Belarus dated January 17, 2020, No. 16, which regulates, amongst others, the responsibilities of the Operator, individual compliance, payment of the fee, and release from obligations
  • draft Decision of the Council of Ministers of the Republic of Belarus On Establishing a List of Products and Packaging and Amount of Fee Payment

In June, the Ministry of Housing and Communal Services proposed a draft Resolution On the Implementation of the Decree of the President of the Republic of Belarus dated January 17, 2020, No. 16, which regulates the allocation of funds for the implementation of waste management measures by the Operator.
