Denmark has now published an Executive Order that will bring packaging extended producer responsibility (EPR) into operation from 1 October 2025.
The legal basis for the Executive Order on Packaging Requirements, Packaging EPR, and Waste Collected with Packaging is provided in an Amendment to the Environmental Protection Act.
Both texts were published on 30 December 2024, after nearly five years of development.
The implementation of the EPR regime had already kicked off in May 2024. Parties obligated for single-use packaging had to register with the DPA (the producer register and clearing house mandated to oversee the Danish EPR system) by 31 August 2024 and join a producer responsibility organisation (PRO) by 14 January 2025.
Parties using reusable packaging had to register by 1 February 2025.
As of January 2025, almost 5,000 entities are registered as producers, of which 4,300 comply collectively through 10 PROs.
Producers must join a PRO. They may establish an individual takeback scheme only if it works in connection with the delivery of a new product to a household.
