Who is impacted by Marketplace EPR obligations?

With e-commerce rapidly growing, digital retailers and merchants are encountering rising regulatory demands, especially in relation to environmental accountability. A key element of this is Extended Producer Responsibility (EPR).

Since the moment you list a product for sale in the European Union, you become a Marketplace Seller with serious legal responsibilities that extend far beyond customer service and shipping.

Under the EPR framework, you are legally obligated to register and report every single item you place on the market across all 27 EU countries you sell into.

This includes:

Packaging

Every box, bubble wrap, and shipping label you use must be registered and reported by weight and material type in each country where your products are delivered.

Electronics

From smartphone chargers to LED lights, fitness trackers to gaming accessories; if it plugs in, runs on batteries, or contains electronic components, it falls under WEEE regulations.

Battery

Batteries

Whether they are built into your products or sold separately, all battery types require registration and takeback schemes in every EU market.

Textiles

Textiles

Clothing, bags, shoes, and home textiles will soon join the list of regulated products requiring full compliance tracking.

What is EPR?

EPR – Extended Producer Responsibility – is a policy that holds producers accountable for their products from design to disposal.

It aims to encourage sustainable design, reduce waste, and ensure proper recycling. Under EPR schemes, producers bear the cost and responsibility for collecting and treating their products at end-of-life.

Main obligations for online sellers in EPR

Under EPR rules, online sellers and marketplace merchants must meet several obligations, which differ from country to country.

Key requirements include registration and reporting. Sellers must register with the relevant EPR authority for each applicable program (e.g., WEEE, batteries, packaging, textiles) in the countries where they operate.

This process usually requires detailed information on the company, product types, sales volumes, and materials used. In many cases, a single product model may fall under multiple EPR programs within one country.

Know the rules

Each European country applies EPR regulations a little differently. Start by understanding the exact requirements in every country where you sell.

Register

Most countries require companies to join a national EPR scheme, which usually involves a fee and details about your business and products.

Label correctly

Products must carry labels that follow local recycling and disposal rules. These can include material details and recycling instructions, which vary by product type and country.

Waste Shipment Regulation: revision adopted

Track and report

Keep accurate records of what you sell. Regular reporting to authorities and take-back systems is mandatory.

“(…) according to the European Directive, the Marketplace Sellers have to make sure that their products are compliant. That means they need a registration for their packaging, a registration for their electronic devices, (…), and a registration for their batteries.”

Martin Hillenbrand – Head of Sales for WEEE and Batteries at Landbell Group

Textiles:

“We always have complete coverage, a one-stop shop solution, which means we can provide compliance ourselves through our own PRO or via our consulting team for marketplace sellers.”
