What is producer responsibility for Single Use Plastic (SUP)?
Single use plastic products are wholly or partly made of plastic and intended to be used once. They are therefore not designed or produced to be returned and reused again and again for the same purpose.
The following categories of single use plastic products are covered by producer responsibility for SUP:
1. Food containers (eg for salad and take-away containers)
2. Wrapping bags and foils (eg for candies and wraps/sandwiches)
3. Beverage containers (up to 3 ltr, inclusive cartons)
4. Drinking cups (eg coffee cups and smoothie cups)
5. Lightweight plastic carrier bags (eg for fruit and vegetables)
6. Wet wipes (for personal care and household)
7. Balloons
8. Filters for tobacco products (cigarettes, snuff (nicotin pouches not in scope)
If you are the first to market single use plastic products or filled single use plastic products on the Danish market, you basically have the producer responsibility for your single use plastic.
If you are covered by producer responsibility for single use plastic products, you must register in the producer responsibility register. Registration must take place for current producers before 17 December 2024.
The Purpose with the extended producer responsibility is to
Reduce the amount of packaging
Increase real reuse and recycling of packaging materials
Force companies to re-design to more circular packaging
As a company, you are given full responsibility for the amount of single use plastic you bring to market and the handling of the packaging until end-of-life. It involves:
- Administrative and legal responsibility (documentation requirements and labelling).
- Economic responsibility (companies to finance costs for logistics, sorting, recycling, registration.
- Practical/physical (sorting in material types, collecting, recycling).
- Clean-up responsibility (You must finance a share of the public cleaning costs for collection, clean-up and disposal, respectively)
Single-use Plastic products, whis are also packaging will face to different fees:
1) Fee as plastic packaging following the rules in the Packaging legislation
2) Clean-up fee following the price per kilo set by the authorities and which can be seen on the Danish EPA’s web site here.
Reporting and payment
Every quarter, the registered companies report the quantities of single use plastics, broken down by category, that they have marketed. The first report to the DPA is marketed quantities for the first quarter of 2025. These must be reported in the period 1-10 April 2025 in the producer responsibility register.
Type 1-5 above must be reported in weight and type 6-8 as number of pieces.
In 2025, producers registered in the producer responsibility register will be charged an annual fee by the DPA to cover the DPA’s administrative costs. We do not currently know the amount of the fee, and the time of collection has not yet been determined.
Especially about labeling
Certain products made of single use plastic are subject to special rules for labelling. These are, for example:
• Filters for tobacco products
• Sanitary pads
• Wet wipes
• Drinking cups
Order banning the marketing of certain disposable plastic products, etc. and on requirements for certain other single-use plastic products
