PackUK's second year: Building on foundations

Since its establishment, PackUK has been tasked with administering one of the most ambitious changes to an environmental compliance system in UK history. The 2026-2027 operational plan demonstrates the scale of this undertaking: forecasts indicate £1.47 billion in chargeable disposal costs for local authority payments, with total fee recovery approaching £1.56 billion.

Recent headlines have focused on government intervention to address revenue shortfalls. However, it's crucial to recognise that PackUK is only in its second year of operation, managing extraordinarily complex data from thousands of producers as well as local authorities submitting complex information. Packaging industry compliance calendar

The PackUK Operational Plan 2026 to 2027 establishes firm deadlines that every producer must observe. NB if you are a member of a producer compliance scheme (85% of producers are) they will set earlier dates for getting your data to them as they have to check your submission before submitting it to the environment agency on your behalf.

Missing these dates can result in penalties, so check with your compliance scheme and mark them clearly in your planning systems.

Data Submission Periods (set in the Regulations):

  • 1st October 2026: Deadline for H1 data submission (January-June 2026 packaging data)
  • 1st April 2027: Deadline for H2 data submission (July-December 2026 packaging data), including mandatory RAM data

Issue of Notices of Liability:

Notices of liability are issued to producers by PackUK.  As all of the scheme costs have to be covered there is a potential need to recalculate fees if data changes significantly.  PackUK plan to only recalculate at certain points in the year.  The timetable looks like this:

  • By July 2026: to have issued the first notices of liability for 2026/27
  • By November 2026: to carry out a formal recalculation
  • Late March 2027: final year-end calculation

Data Stability Cut-offs

To reduce the impact on the scheme (and all producers) of late data resubmissions by local authorities and producers PackUK are proposing to implement data stability cut-offs (At the moment these have been proposed by Pack UK and are currently being discussed with stakeholder groups):

  • 1st May 2026 (proposed): Revised local authority data generally not accepted after this date
  • 1st October 2026 (proposed): Producer resubmissions which result in lower obligations generally not processed after this point

These deadlines reflect PackUK's efforts to balance flexibility with system stability. The data stability measures prevent last-minute changes that could destabilise fee calculations and local authority payments, ensuring the scheme operates predictably.

Payments to Local Authorities:

Payments to local authorities are calculated using the Local Authority Packaging Cost Allocation Performance (LAPCAP) model for England, Scotland and Northern Ireland. Wales employs a bespoke distribution model agreed with the Welsh Government, reflecting regional variations in waste management infrastructure.

The total of these payments in each year needs to be covered by producers (in addition to PackUK’s operating costs, communications programme and an allowance for unpaid fees)

Understanding your EPR bills: Fee structures and eco-modulation

The packaging industry faces a more sophisticated fee structure in 2026/27, with eco-modulation now being applied to fees for the first time. This approach incentivises the use of recyclable packaging by producers whilst ensuring producers pay their fair share of the total costs of managing packaging waste from households.

Eco-Modulation Rates: Household Packaging is assessed and assigned to three categories based on recyclability:

  • Green rates: Most recyclable packaging, lowest fees
  • Amber rates: Moderately recyclable packaging, mid-tier fees
  • Red rates: Least recyclable packaging, highest fees

This tiered system creates clear financial incentives for producers to improve packaging design. The recyclability assessment methodology (RAM) provides the technical framework for determination of recyclabulity, and H2 2026 data submissions (as well as all future submissions) must include RAM assessments.

And the modulation factor for packaging assessed as red is ramping up over the next three years (120% in 2026/27, 160% in 2027/28 and 200% in 2028/29) – so small changes in packaging design which shift materials between categories, can potentially generate substantial cost savings for your business in future years.

Digital Service Improvements: The digital reporting platform for the new system – Report Packaging Data (RPD) has faced some challenges.  PackUK are targeting 99.5% availability for RPD, with enhanced data validation, automated checks and streamlined payment processing. These improvements reduce administrative burden for producers while improving data quality across the system.

Public Information Investment: Targeted funding will enhance WRAP's Recycle Now Locator[2], improving consumer access to packaging recycling information. Better public understanding drives higher recycling rates, ultimately reducing disposal costs and local authority payments.
