Who needs to comply?

Your business has packaging compliance obligations if you:

  • Handle more than 25 tonnes of packaging in the UK in a calendar year
  • Have a turnover of more than £1 million per year

Note: If you are part of a UK group of companies, these obligations apply to the entire UK group via the common parent/ -holding company.

Failure to comply is an offence and may result in enforcement action, including payments for previous years of non-compliance.

Packaging compliance refers to adhering to regulations and standards governing the design, production, use, and disposal of packaging materials. It ensures businesses meet their environmental obligations related to packaging waste, promoting recycling, reducing waste, and minimizing environmental impact. This includes compliance with regulations like the Producer Responsibility Obligations (Packaging Waste) Regulations and the Packaging (Essential Requirements) Regulations.

If you are classed as a Packaging Producer under the regulations, you need to register your organization, report packaging data, and ensure your packaging is properly managed (collected and recycled/recovered). You also need to be aware of and pay any relevant fees. You can do this yourself or through a compliance scheme.

The cost of packaging compliance in the UK, under the Extended Producer Responsibility (EPR) scheme, varies depending on factors like the type and quantity of packaging, and whether a business is a small or large producer. It includes fees for registration with the Environment Agency, and potentially joining a compliance scheme, plus the cost of purchasing Packaging Recovery Notes (PRNs) or Packaging Export Recovery Notes (PERNs).
